TERMS & CONDITIONS
Please read before confirming your order with us. Payment of your booking fee confirms your agreement to the following:
Standard Terms and Conditions of Trading
These terms form the basis of the contract between our customer and Bakes With Love. These Terms, your Order and your Order confirmation are considered by us to set out the whole agreement between you and us for the sale of cakes. It is your responsibility to check all details in the order confirmation are complete and accurate as this is the document we work to when completing your order.
Basis of Sale
Any samples, drawings, or descriptions we issue, and any descriptions or illustrations contained on our website are issued solely to provide you with an approximate idea of the cakes they describe and remain the property of Bakes With Love.
No contract is made with you until we have received your booking fee. Once your booking fee has been received you are in a legally binding contract with Bakes With Love.
The Cakes
We warrant that on delivery or collection the Cakes shall conform to their description as set out in the Order Confirmation, be of satisfactory quality and comply with all food safety, statutory and regulatory requirements in the UK. We will not be held responsible for customer disappointment of the design or the interpretation of the cake if it is made in line with the customer’s pre-agreed requirements set out in the order confirmation and will face no consequent liability. It is the customers responsibility to ensure all details within the order confirmation and sketch are correct and meet their exact requirements.
The warranty does not apply to any defect in the Cakes arising from wilful damage, accident, negligence by you or any third party, if you use the cake in a way we do not recommend, your failure to follow our instructions or any alterations you carry out.
Our cakes are made in an environment where nuts, egg, milk, gluten and other allergens are present. We cannot guarantee that any cake is entirely nut free although we make every effort to ensure that allergies are accommodated.
We cannot guarantee an exact replica of any cake. Where colour swatches are provided, we will do our best to match as close as we deem possible. Exact colour matches are not guaranteed.
Fresh flowers are not included in the price of any wedding cake design unless specified. If a wedding cake is to be dressed in fresh flowers, ensure these are removed prior to serving. NB. Please note some flowers are not suitable for use as a cake decoration. If flowers for the cake will be provided by your florist, ask them for details regarding toxicity prior to purchasing. We cannot be liable for any contamination to our food product that may arise from their misuse. We recommend that your florist liaise directly with us to confirm detail about the size of cake being dressed to avoid any miscommunication.
Stacked cakes contain dowels in each tier to provide support and these should be removed before consumption.
The cake is a fresh product containing no additives or preservatives and it is our right to assume consumption on the day requested. Cakes should be stored in a dry place, at room temperature, away from direct sunlight and sources of heat in the box provided. Some cakes may require refrigeration depending on the filling.
Bakes With Love and the customer expressly agree that the cakes and all goods purchased from Bakes With Love remain the property of Bakes With Love until paid for in full.
Quotations & deposits
Quotations are valid for 30 calendar days - once this time has passed, we cannot guarantee the quotation will remain the same.
A non- refundable deposit of £100 is payable on wedding cakes. Celebration cakes require a 50% deposit. Paying your booking deposit secures your chosen date and means you have agreed to our terms & conditions.
All deposits are non-refundable.
Until the deposit has been paid, your chosen date remains available for others to book.
Remaining Balance
For wedding cakes, the remaining balance must be paid no later than 2 weeks prior to the wedding date.
For celebration cakes, payment must be made in full prior to collection.
If payment has not been made prior to collecting, we can withhold your order until the balance has been cleared.
About the cakes
Cakes are baked in an environment that handles nuts, eggs, gluten, and dairy; therefore, it cannot be guaranteed that our cakes are free of allergen substances. You are responsible of advising your guests of this, and we do not accept any liability for any loss, damage, or injury caused by allergic reactions to our cakes.
All ingredients used are suitable for a halal diet.
Final design
All cakes will be made according to the design agreed between us and you, the client, however as the designer, we reserve the right to make design changes as we see fit.
We cannot guarantee exact copies of cakes - as each cake is individually made, designs are subject to differences.
Based on the final design, there may be elements that are not edible on the cake (fresh flowers, ribbons, beads etc.). These are to be removed before serving
Delivery/collection
Single tier cakes are available for collection only from our location based in Luton, Bedfordshire. Two tiered cakes or more can be delivered for an additional fee.
Initial quotes for custom cakes will include delivery and setup to your chosen venue provided you have given us the venue location including postcode - we offer delivery within Luton, to surrounding areas, and to London.
A photograph of the cake will be taken for proof of delivery and its condition. Once your order has been delivered or collected, we will not accept any responsibility for any damage that occurs thereafter.
If the cake is to be setup on a cake table, please ensure the table is positioned where you want it, as we cannot be held liable for any damage if the table is moved or repositioned after delivery.
We are not held responsible for any loss, damage, or delivery if you request us to leave the cake somewhere, or with someone.
We do not hold any responsibility for adverse weather conditions affecting access to any venue. We will attempt to deliver to the venue when we deem it safe enough to do so.
Items for hire
We offer stands, floral bases, and separators for hire that will incur an additional safety deposit payable with the final balance.
Each item incurs its own individual safety deposit. All items hired out must not be defaced or damaged and remain your responsibility until they are returned to us.
Hired items must be returned in good condition within 7 days after the event, unless specifically requested by us. Safety deposits will be refunded after inspection upon return.
Damaged, broken or lost items remain the property of Bakes With Love, and a replacement fee will be sent out to the client, for us to replace the item like for like, including p&p.
Cancellation/postponement
In the event of a cancellation by yourselves, charges are as follows:
More than ninety days prior to the date = booking fee only.
Ninety days to thirty days prior to the date = booking fee plus half the remaining cost.
Less than thirty days prior to the date = full amount
Celebration cakes may be cancelled with one week's notice. After this, the full amount is non-refundable (including the booking deposit).
You may postpone your booking, provided we have availability for your new chosen date.
You may do this only once, without additional cost - any further postponements will be considered a cancellation. If we unable to cater for your new chosen date, our cancellation policy (above) remains.
In the unlikely event that we need to cancel, any payments made to us will be refunded. We cannot be held responsible for any 'Acts of God' (Fire, flood etc), Government Advice, Pandemics, labour disputes, failure of electricity supply, non-availability of material or supplies, and any other unforeseeable circumstance beyond our control that prevent the promise of its services.
Complaints
Complaints are very rare and due to the amount of work put into each individual cake we take them very seriously. Any issues must be bought to our attention with 48 hours on collection or delivery to give fair opportunity to assess the nature of the complaint.
Both Parties agree to not post any negative information about the other arising out of this Contract or Event on any online forum or website without providing advance written notice of the intended content thereof and providing the other party with a prior opportunity to resolve any issues between the parties amicably.
Where the complaint is regarding the quality of the cake then the cake, or remainder of the cake/tier, must be returned to us as soon as possible after cutting and within 48 hours of collection/delivery to ensure that we are able to fairly assess the nature of the complaint.
Please note we can only deal with the client who placed the original order.
General Terms
All designs and intellectual property rights remain the property of Bakes With Love.
We reserve the right to use images of your cake for any form of advertising including web-based promotions, brochures, galleries and competitions. It is advisable that you make a copy of all documentation received from Bakes With Love for your own benefit.
